過去一年來，隨著馬幣幣值的下跌，加上國際原油以及全球經濟不景，連帶馬來西亞房地產市場也趨向淡靜。

然而，我常說“危機便是契機”，特別在這樣艱難的時刻，有實力的投資者在這樣的大環境下，雖然要看緊錢包，也應該更有智慧的判斷，到底哪些投資項目還是值得投資的，也更趁這個時刻抓緊投資契機，贏到最後。

個人認為，雖然經濟前景不明朗，但保值最好的投資仍然是房地產。雖然目前投資市場放緩，但好地段的房地產，往後升值仍然前景看俏。

當然，投資者在投資的當而，也必須做足功夫瞭解其中所涉及的稅務知識，因為任何買賣，一旦有了盈利就要繳稅。因此，投資者應盡力減低投資所必須繳交的稅款，獲取最大的回酬。

我日前獲得一項大型房地產投資展銷會的邀請，在會上與投資者分享一些時下的投資貼士，以及必須瞭解的稅務知識。現場更有人提及前幾天的報章報道，即售逾200萬令吉商用物業的個人業主，關稅局將追收6%的消費稅的課題。

其實，自消費稅於2015年4月1日實施以來，仍然還有人對投資商用物業的消費稅徵收規定，特別是是否需徵收消費稅一知半解。針對相關的報道，我這裡也想和各位讀者再次分析與分享我已處理多宗商用物業消費稅個案的經驗，到底投資物業，在怎樣的情況底下，必須徵收消費稅。

消費稅法令下，物業可分3種，即用於住宅、商業及農業用途；住宅與農業用途的物業為豁免納稅供應，商業用途的物業則需徵收消費稅。

在過去，商用物業的規定沒有那麼嚴格，即若個人在12個月內，手上擁有或售賣不超過2間商用物業或少過1英畝的商用土地，相關物業無需徵收消費稅。

然而，根據關稅局的最新規定，任何人士只要被視為有意進行“買賣”生意，並達到關稅局的規定，就必須成為消費稅註冊商家。

有意進行“買賣”生意的定義在於，個人在任何時候只要：a.擁有超過2間商用物業；b.擁有超過1英畝的商用土地；或c.擁有的商用物業或土地市價超過200萬令吉。

於此同時，相關人士被視為有意出售相關商用物業或土地，以及在12個月內買賣的總額超過消費稅註冊門檻，即超過50萬令吉。

以下為一些個案，讓大家作為參考：一名業主擁有3間商用物業的市價少過200萬令吉，並以40萬令吉出售其中一間物業，相關業主是否必須徵收消費稅？根據新規定，相關業主因為擁有超過2間商用物業，已經符合了關稅局被視為有意進行“買賣”生意的定義。

然而，若業主在12個月內，出售物業的總額只有40萬令吉，即還沒達到關稅局規定的消費稅註冊門檻，相關業主無需註冊成為消費稅註冊商家，並徵收消費稅。

另外，若一名業主擁有一間市價300萬令吉的商用物業，並以320萬令吉出售相關物業，相關業主是否必須徵收消費稅？這裡必須提醒大家的是，雖然相關業主只擁有一間商用物業，但因為相關物業的市價超過200萬令吉，已經符合了關稅局被視為有意進行“買賣”生意的定義，加上物業出售價為320萬令吉，超過關稅局規定的消費稅註冊門檻，相關業主必須成為消費稅註冊商家，並徵收消費稅。

與此同時，另一名業主擁有2間市價170萬令吉的商用物業，並以90萬令吉出售其中一間物業，相關業主是否必須徵收消費稅？由於相關業主只擁有2間商用物業，加上其市價沒有超過200萬令吉，因此不被歸類於關稅局“買賣”生意的定義內，就算售出物業的價格即90萬令吉，已超過關稅局規定的消費稅註冊門檻，相關業主仍舊無須成為消費稅註冊商家，以及不能徵收消費稅。

希望以上的個案能夠幫助一些正在為消費稅煩惱的投資者們。

其實，個人認為關稅局的這項新規定可算過於苛刻。特別是針對個人在任何時候，不能擁有超過2間商用物業，以及物業或土地市價不超過200萬令吉的規定。

試問現今社會，大部份作為商用物業的投資人，哪些手頭上不會同時擁有超過2到3間的物業？更何況，若投資在物業價格高企的地點，特別是隆雪、檳城、新山及亞庇這4區，一間商用物業的市價，就可能已經超過200萬令吉了。

因此，個人認為，關稅局應與時俱進，對到底投資多少物業與價格才算是“做生意”的定義，應隨著現今市場物業價格的普遍高企，為目前的規定作出更改！（星洲日報／本報特約‧作者：孔令龍‧稅務專家）
